This action was commenced on April 8, 1954 by the plaintiff, John J. Davies, of Milwaukee, against the defendant, J. D. Wilson Company, a corporation, of the same place, for the recovery of commissions claimed due by plaintiff for services as a salesman of the defendant company under an oral contract of employment between the parties. The complaint demanded judgment for unpaid commissions alleged to have been earned and due on Globe Steel Tubes Company (hereinafter referred to as Globe), and Bucyrus-Erie Company (hereinafter referred to as Bucyrus-Erie) accounts, as well as others. The defendant by its answer denied owing the commissions. It counterclaimed for specific amounts alleged due and owing from the plaintiff including inter alia the recovery of $1,057.40 paid to the plaintiff by mistake as a commission installment, and also for the recovery of damages claimed to have resulted when plaintiff wrongfully removed certain correspondence, papers and documents from defendants files and withheld the same to the defendants prejudice.
